Terms and Conditions
1. Rental Policy
- Guest making the reservation must be 26 years of age or older.
- Guest making the reservation must be present during the entire term of the contract, be named on the major credit card used for payment, have matching photo ID/passport/driver’s license, and billing address.
- The credit card on file must remain valid throughout occupancy as well as inspection and processing period
- Occupancy may not exceed 24 adults or 28 when children are combined with adults in the rental. All guest names and ages must be completed on provided forms. Any deviation from the names provided or over occupancy of the property may result in eviction or cancellation of the reservation.
- All guests staying in the home must be registered with the provided forms. Outside guests are not permitted without prior approval.
- Rental may not be used for events or group gatherings that exceed occupancy or for events that are outside of a normal vacation rental, including weddings, parties, or social events. Any variance to this policy must be preapproved in writing prior to 30 days before occupancy.
- Commercial photography or video is not allowed unless written permission is obtained. Commercial video or photography for any lewd or vulgar purposes is strictly prohibited.
- Contract will be sent to guests after inquiry is made. The signature of guest represents the responsible renter but all listed renters shall be individually and completely responsible for the performance of all obligations under the contract, jointly and individually with every other renter. All guests/occupants must be listed in the contract. By booking your rental of the Property, you acknowledge that you have read and understand, and agree to be bound by all terms, conditions, and policies in the contract.
2. Payment Terms and Conditions
- For reservations made more than 60 days in advance, a 25% deposit is required.
- 60 days before the reservation, the credit card on file will be billed the remaining balance automatically unless other arrangements have been made
- Total balance is due upon booking a reservation that is made less than 60 days before occupancy date.
- Applicable taxes as mandated by the state of Florida and Osceola County will be added to the total rental amount. These taxes include Florida sales tax and Tourist Development Tax. Some outside booking sites may collect only the Florida state tax but do not assess Osceola County or other taxes. All unpaid taxes will be assessed appropriately.
- Security deposit of $2500 is required and is used to cover damage and/or loss of contents to any home contents. This security deposit will be processed minus any damages/loss within 14 days after guest checkout.
- The guest making the reservation must be present during the entire term of the contract, be named on the major credit card used for payment, and have matching photo ID/passport/driver’s license, and billing address.
- Guest agrees not to assign this Agreement or sublet the Property.
- By signing this contract the guest understands they are responsible for the cost of damages to the property, furnishings, décor, or contents during their stay.
- Trip insurance is encouraged
3. Cancellation Policy
- All reservation deposits are non-refundable.
- Cancellations must be provided in writing and the following conditions apply to any refund of monies paid: 25% penalty for reservations cancelled greater than 60 days prior to arrival date, 50% if less than 60 days prior to arrival date, 75% if less than 30 days prior to arrival date, and 100% if less than 15 days.
- Any change to the booking dates or length of stay reduction will follow the same cancellation fee rules
- Nonpayment will also result in loss of monies and cancellation of the reservation.
- After cancellation, owner will attempt to relist the property. Because of the nature of large vacation rentals, rebooking on short notice is problematic. If the property is re-rented during your previously reserved time period, owner will reimburse the guest any applicable payments minus a 10% rebooking fee. The owner is under no obligation to rent the property or rent the property for the same amount.
- On an individual case by case basis, owner will consider applying the 10% rebooking fee toward a future rental.
- Late arrivals or early departures does not warrant any refund or credit to the payment amount.
- Trip insurance is encouraged.
4. General Occupancy Terms
- Guest is granted a license to use property and no tenancy has been created. License begins and ends on the dates specified on the contract. Guest may not change agreement, assign agreement to third party, or sublet the property.
- Guests shall care for the property as if it was their own, and leave it undamaged, clean, and safe during their occupancy.
- All household furnishings must only be used for their intended purposes and no rearranging of furniture is allowed on the interior of the house.
- Trash must be taken out on designated trash days.
- The home contains 5 air conditioning zones that control different areas of the home. The units must not be set below 72 degrees Fahrenheit. Setting the units below this point may result in the units freezing up. When this occurs, the units must be turned off until the unit thaws, resulting in a warm, uncomfortable house for many hours. Any service calls for this reason will be charged to the guests.
- All windows and doors must be shut if the AC units are on. If the climate permits and sliding doors are open, all AC units must be turned off.
- Guests shall not deliberately destroy, deface, or damage the property nor disable smoke or pool detector alarms.
- Property is within a guarded, monitored and gated community. Guests agrees to abide by all neighborhood and HOA rules. If any law or community rule is violated, occupancy may be terminated immediately without refund
- Property descriptions are made in good faith but owner takes no liability for errors and omissions.
- Property comes equipped with washers, dryers, refrigerators, freezer, microwaves, dishwashers, coffee makers, toaster, iron, ironing board, high chair x 2, dishes, cookware, utensils, and hairdryers, pack-n-play x 2, USB chargers as well as linens and towels.
- Complimentary soap, toilet paper, dishwashing soap, and trash bags are also provided. Once these items are used, however, it is guest responsibility to replenish them. Food items are not provided. If you find food products in the kitchen, you agree to use them at your own risk.
- The owner and/or the property manager do not accept liability for lost or stolen personal property of the guest during their stay. If property from the guest is stolen they should notify the property manager and the appropriate authorities.
- Owner representative may enter property at any time for the purpose of inspection, maintenance, or emergencies. When possible, we will provide notice to guest before entrance.
- Guests must inspect the property upon check in and notify property management/owner within 4 hours of arrival if there is any existing property damage or unacceptable conditions.
- Guests are responsible for any damages sustained to the property during their stay including to the property or its décor, or loss of contents.
5. Trip Insurance
- Trip insurance is optional but highly recommended and is offered through many third party vendors including Generali Global Assistance.
- Trip insurance needs to be purchased at least 60 days prior to arrival date.
6. Hurricane Policy
- We do not offer refunds for hurricanes but again encourage guests to purchase trip insurance. Although not common in our area, it does happen. Peak hurricane season is typically from August through mid October.
- In some cases hurricane watches or warnings will cause certain preparations in the home that may disrupt guests’ experiences including securing outdoor furniture or other physical structures. We cannot take responsibility for the inconvenience that this may cause to a guests’ stay.
7. Check-In/Check-Out
- Check-In time is 4:00 pm.
- Check-Out time is 10:00 am
- Please do not deviate from these times without prior permission since other guests may be departing or arriving on the same day.
- A fee will be applied for last minute and/or unapproved early check-ins or late check-outs.
8. Early Check-In/Late Check-Out
- Early check-in or late check-out can only be arranged 3-7 days prior to arrival or departure and its availability depends on arrival/departure times of other booked guests as well as cleaning timetables. Since cleaning of the house must be scheduled, this option cannot be added on the day of departure.
- Early arrival or late departure will incur a 50% daily fee unless otherwise arranged. Arranged early arrivals must not be before 9:00 am and late departures must not be after 5:00 pm.
9. Maintenance Service
If a problem arises during your stay, maintenance services are available 24 hours a day, 7 days a week. During regular business hours maintenance calls will be addressed as quickly as possible. There could be delays in after hours calls. After hours calls that are not deemed emergency may be postponed until the next day. Emergencies are defined as an issue that makes the property unsafe for occupancy or may cause imminent danger/damage to the property. In the event it is found the maintenance issue was caused by guest neglect, misuse, or abuse, the guest will be held responsible for all costs of the repair.
10. Housekeeping
A property-cleaning fee will be added to the reservation for all rentals less than one week in length. If additional extra heavy cleanings are needed after check out these will incur an additional charge. Mid-stay cleans are optional services that will incur additional fees. Every effort will be made to accommodate the guest on requested times for additional cleans. This option may not always be readily available and therefore it is recommended that these be scheduled in advance.
11. Pool Heat
- Pool heating is an optional amenity and may be added to your reservation for an additional fee of $60/day but must be made for the entirety of your stay.
- When pool heat is added to the reservation, the heat will run for approximately 8 hours a day, from the midmorning hours until early evening.
- Since the pool heat is on a timer and operates during the time, there will be cooling off during the night. Although Florida is usually temperate, there will be times, especially during late December through February, when cold fronts force temperatures into the 30s. During this time, and any time the air temperature drops below 55 degrees Fahrenheit, the heating system may not adequately maintain the pool temperature in the mid to upper 80s. Often pools will not heat above 15-20 degrees Fahrenheit above ambient temperatures. This is out of the owner’s control and no refunds will be given.
12. Prohibited Uses (smoking, drugs, firearms, pets)
- Smoking, vaping, illicit/illegal drugs, fireworks, and illegal firearms are strictly forbidden on, in, or around the property.
- Pets or animals of any kind are prohibited on, in, and around the property
- Guests may not use the property for any illegal or immoral activity or any violation of Florida Chapter 509.142.
- Violation of these rules is grounds for expedited eviction and no refunds will be given.
- Failure to honor these house rules will result in a $1000 fine charged to the credit card on file along with all needed cleaning or replacement fees to damaged property including but not limited to carpets, bedding, draperies, window treatments, and air conditioning vents as well as any lost rental income to accomplish the cleaning.
13. Parking
- The property is limited to three parking accommodations within the driveway with additional parking available on the street. Owners encourage rental of full-size vans such as the Mercedes Benz Sprinter, Ford Transit, Nissan NV, or Chevrolet Express to promote efficient parking at the property.
- No RVs, campers, trailers, or boats are allowed in the neighborhood.
- Guests must abide by all neighborhood, HOA, city, and state parking rules and obey all posted driving signs.
- Owners are not responsible for theft or damages to vehicles.
14. Quiet Times
- Quiet times are from 10:00pm until 7:00am. Please be respectful of other travelers so that we can maintain a good relationship with our neighbors.
- Owner does not control other homes or people staying there. If they are violating the quiet time rules, contact Reunion Resort Security or the Osceola County Sheriff’s office.
15. Safety
- Guest safety is the utmost importance to owner. However, owner cannot accept any responsibility for guest safety during their vacation. Minors must be supervised at all times and all rules must be explained to all guests. You understand the risks and agree that you will assume all responsibility.
- The pools are used at guests’ own risk and no lifeguards are on duty. Minors must be supervised at all times. No diving or horseplay is allowed.
- A pool safety fence is installed and must be used at all times. If the guests remove it, they assume all responsibility and risks of its removal.
- The back doors with pool access are alarmed for child safety. It is illegal to tamper or disconnect these alarms and doing so is considered a misdemeanor under Florida law. Repair to any of these devices will be charged to the guest.
- Because of higher water temperatures, hot tubs may increase risks for certain medical conditions including, but not limited to, heart disease, diabetes, peripheral vascular disease, and pregnancy. Guests should understand their medical conditions and assume all risks to using the hot tub.
- Both a gas grill and gas flame gathering area are located in the back yard. Lighting and cooking with these devices can be dangerous and owner assumes no responsibility for their use. Guests take full responsibility and assumes risk for their use.
- No minors are allowed in the workout facility and guests assume full responsibility of its use; guests must follow safe workout practices
- A modern freestanding staircase has been installed in this property. Because of its modern design, a 2 inch gap has been left between the steps and glass railing. Children and adults must be aware of this gap and children should be supervised when on these stairs.
- Outdoor balconies contain glass railings. No climbing on or horseplay around the railing is allowed nor is anyone allowed to areas outside the railing enclosures. No access to any other roof area is allowed beyond these balconies and children must be supervised at all times. On the third floor balcony, one area is enclosed by the framed structure of the home and contains no railing above this wall. Wall, however, is higher than glass railings. No climbing is allowed on this wall and no access to the roof area above is allowed. Balconies are defined one-level structures and no access is allowed above or below these levels.
- Games, toys, baby furniture/equipment are used at the guest’s own risk. Young children must be supervised at all times.
- Children should not be allowed to use features intended for adults where they could potentially injure themselves; young children should also not be allowed to use items such as the billiard table or other items where they could potentially cause damage.
- Florida wildlife may pose a danger; common wildlife includes but is not limited to alligators, snakes, and mosquitoes. Care must be taken, especially around water areas. Feeding of alligators and many other animals is illegal. Appropriate insect repellent may be needed.
- We cannot guarantee that property is free of allergens including but not limited to peanuts, perfumes, lotions, and cleaning solutions.
- For any life-threatening emergency, call 9-1-1.
16. Property Monitoring
In order to maintain the property and to ensure both current and future guests’ stays are pleasant, efficient, and memorable, certain monitoring may or may not be in use at this property. These include but may not be limited to remote door lock controls, AC thermostat controls, and pool heater thermostat controls. These controls will enable efficient/safe check in and departure as well as control of interior and pool temperatures. If used in this particular home, noise level, signal detection, and exterior surveillance devices are meant to address problems before they arise. Surveillance video devices are only used on the exterior of the house and will not overlook pool or outdoor living areas. No interior video devices are installed in the house. Noise detection devices do not record personal conversations but only measure decibel levels and signal detection devices only count device numbers and do not collect any personal information.
17. Personal Items Left Behind
- When personal items are left behind, owner will make every effort to locate the item. If the item(s) are located, guests will be given contact information of local company in order to make arrangement for the return.
- However, owner is not responsible for any losses. Any unclaimed properties will be removed from the property.
18. Reunion Resort Amenities
- If you desire the option to use the water park, tennis center, golf courses, and exercise facilities, then guest passes can be applied for. The water park charges $25/day for up to 8 guests and an additional $5/guest will be charged for more than 8 guests. Arrangements for guest passes to the water park must be made more than 7 days prior to arrival. Golf green fees and tennis fees are additional. These can be done for only the days desired but these dates have to be specified to the club ahead of time. Owner, however, cannot guarantee access to Reunion Resort amenities.
19. System Failures/Unforeseen Circumstances
- Owner cannot assume liability for public supplies such as water, electricity, or gas supplies or other situations that we do not control. This includes but is not limited to weather, airport delays and cancellations, war, terrorism, flood, fire, strike, or civil unrest. No reimbursement will be given to reservations that are impacted, either late check-ins, early departure or no shows, by these circumstances.
- Owner also cannot accept responsibility for home systems unexpectedly breaking down or being impacted by weather, including but not limited to sewer, air conditioning and heating, water, pool heater, refrigerator, freezer, household appliances, internet, cable and satellite TV. Owner will make every possible effort to rectify these situations but will not be held accountable.
20. Force Majeure
Circumstances may arise, out of the owner’s control that might make the property uninhabitable. If this is the case, owner agrees to reimburse guest for any unused portion of the contract but this will be the full extent of the owner’s liability to the guests. Owner will make an attempt to relocate the guest but cannot make any guarantees.
21. Indemnification
To the maximum extent permitted by law, Guest agrees to indemnify and save harmless owner, property management company, agent, or its representatives, from any liabilities, loss, damage, cost, expense, whatsoever arising from or related to any claim or litigation which may arise out of or in connection with your use and occupancy of the property, including but not limited to any claim or liability for personal injury, emotional distress, death, loss of property, or damage whether indirect, incidental, consequential, or exemplary incurred or sustained by you, your guests or invitees, and without regard to whether such persons have authority under this Agreement to be upon the premises of the property.
